1. Introduction and Acceptance
These Terms and Conditions of Service ("Terms") govern your access to and use of the services, facilities, courses, programs, and website (collectively, the "Services") provided by Abba Care Institute, a registered institute in the Kingdom of Bahrain ("Institute," "we," "us," or "our").
By registering for any of our Services, accessing our premises, or using our website, you ("Trainee," "User," "You," or "Your") acknowledge that you have read, understood, and agree to be legally bound by these Terms. If you are a minor (under 18 years old in Bahrain), these Terms must be agreed to by your parent or legal guardian. If you do not agree to these Terms, you may not access or use our Services.
2. Registration and Accounts
2.1. You must provide accurate, current, and complete information during the registration process and must update such information to keep it accurate.
2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2.3. The Institute reserves the right to refuse registration or cancel an account at its sole discretion.
3. Services, Fees, and Payment
3.1. All course descriptions, schedules, and fees are as published by the Institute and are subject to change. The Institute reserves the right to modify course content, schedules, and instructors.
3.2. Fees must be paid in full or according to the agreed payment plan prior to the commencement of the service, unless otherwise stated in writing.
3.3. Accepted payment methods will be specified by the Institute.
3.4. All fees are stated and payable in Bahraini Dinars (BHD) unless otherwise indicated. Fees are non-refundable except as explicitly stated in the Institute's Refund & Withdrawal Policy (Section 4).
4. Refund, Cancellation, and Withdrawal Policy
4.1. Student Withdrawal: Requests for withdrawal must be submitted in writing. Refunds, if applicable, will be calculated from the date of written receipt of the request.
4.2. Institute Cancellation: The Institute reserves the right to cancel or reschedule a course/program due to insufficient enrolment or unforeseen circumstances. In such an event, students will be offered a full refund or the option to transfer to an alternative course.
4.3. Refund Schedule: Specific refund percentages (e.g., 100% refund before start date, 50% before the second session, etc.) will be clearly outlined in the student enrolment agreement or course brochure. No refunds will be issued after a specified period from the course start date.
4.4. Non-Refundable Fees: Registration/administration fees are typically non-refundable.
5. Trainee Conduct and Obligations
5.1. You agree to adhere to all Institute rules, policies, and codes of conduct as communicated, including those related to attendance, academic integrity, and use of facilities.
5.2. You must behave respectfully towards instructors, staff, and other students. The Institute prohibits harassment, discrimination, disruption of classes, damage to property, and any illegal activity.
5.3. The Institute reserves the right to suspend or terminate your enrolment without refund for violations of conduct rules, non-payment of fees, or poor attendance deemed detrimental to your progress or the learning environment.
6. Intellectual Property
6.1. All course materials, including but not limited to textbooks, handouts, presentations, online content, and software, provided by the Institute are protected by copyright and other intellectual property laws.
6.2. Materials are provided for your personal, non-commercial educational use only. You may not reproduce, distribute, modify, or create derivative works of the materials without the Institute's prior written consent.
7. Privacy and Data Protection
7.1. The Institute collects and processes your personal data in accordance with its Privacy Policy and the laws of the Kingdom of Bahrain, including the Personal Data Protection Law (Law No. 30 of 2018).
7.2. By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy, which is incorporated into these Terms.
8. Limitation of Liability and Disclaimer
8.1. The Services are provided on an "as is" and "as available" basis. The Institute makes no warranties regarding specific outcomes, including but not limited to employment, exam results, or certification success.
8.2. To the maximum extent permitted by Bahraini law, the Institute shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
8.3. The Institute's total liability for any claim arising out of or relating to these Terms or the Services shall not exceed the total fees paid by you for the specific course or service from which the claim arose.
9. Force Majeure
The Institute shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, government actions, pandemic, epidemic, curfews, or interruptions in utility services.
10. Amendments
The Institute reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website or notifying you directly. Your continued use of the Services after such changes constitutes your acceptance of the revised Terms.
11. Governing Law and Dispute Resolution
11.1. These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain.
11.2. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the Kingdom of Bahrain.
12. Entire Agreement
These Terms, together with any signed enrolment agreement, the Privacy Policy, and any other specific policies referenced herein, constitute the entire agreement between you and the Institute regarding the Services and supersede all prior agreements and understandings.
